General

ARTE ÉDUCATION, a simplified joint stock company with capital of €750,000, registered with the Nanterre Trade and Companies Register under SIREN number 844 865 212, with its registered office at 8 rue Marceau 92 785 Issy Les Moulineaux, France, operates an educational and cultural website intended exclusively for the educational sector, called “EDUC’ARTE”, accessible via the Internet at the following URL: educ.ARTE.tv www.educarte.fr, which allows teachers and students from Institutions that have subscribed for an annual membership to the Website from ARTE ÉDUCATION to access:

via video on demand, a catalogue of audiovisual programmes in French and German, with subtitles for the deaf and hard of hearing and/or audio description where applicable, available for streaming and/or temporary download.

Consultation and use of the Website and the Audiovisual Programmes, as well as use of the Video Player, are governed by these Terms of Use (hereinafter referred to as the “TOU”).

The applicable version of the Terms of Use is the one in effect at the time the User connects to and browses/uses the Website and Audiovisual Programmes.

However, ARTE ÉDUCATION may update the TOU in order to adapt them to changes to the Website and/or its use, as well as to technical and/or legal developments. Such changes shall be brought to the attention of the User by simply posting them online. As a result, the TOU are deemed to have been accepted without reservation by any User who accesses the Website after they have been posted online. It is therefore advisable to consult the Terms of Use regularly to be aware of any changes made to them and to the version in force at the time of viewing and using the Website and Audiovisual Programmes.

ARTE ÉDUCATION reserves the right to take legal action against the User in the event that they violate these TOU.

Each provision of these TOU is valid separately and remains valid and applicable independently of the others.

In the event that the User is a minor, it is hereby reiterated that parents (or legal guardians) are responsible for ensuring that the User complies with these Terms of Use. Likewise, they are legally bound to monitor their children’s (or minors’) use of the digital resources (audiovisual programmes, video player, etc.) made available by the Website.

 

DEFINITIONS

In these Terms of Use, the terms below shall have the following meanings:

Institution(s)”: refers to educational institutions that have subscribed to the Website with ARTE ÉDUCATION, it being specified that educational institutions shall be understood to mean primary and secondary schools, apprentice training centres (CFAs), higher education institutions for teacher training and education (INSPEs), as well as training centres related to the teaching of French or German and/or education in France and Germany, and French and/or German educational institutions abroad.

User(s)”: refers to students, teachers (as well as other staff involved in educational activities) at the Institutions.

Website”: means the Website currently known as EDUC’ARTE operated by ARTE ÉDUCATION, which aims to provide Institutions and Users with a digital educational tool currently accessible via the following URL: educ.ARTE.tv or www.educarte.fr, giving them access to: a video on demand site with a catalogue of audiovisual programmes, in French and German, accessible to Users by Streaming or Temporary Download;

Video on Demand”: the provision of Programmes to Users, directly or indirectly, via any electronic communication networks and/or means, with access control, in order to allow access, upon individual request, via the following methods (Streaming or Temporary Download), on any reception device (TV screen, computer, personal digital assistant, mobile phone or other mobile receiver, etc.), regardless of the location and at whatever time chosen by the User.

Programme(s)”: refers to the audiovisual Programmes offered on the Website.

“Streaming”: technology that allows Users, upon request, to access the Programme via the Service for the sole purpose of viewing it (without any possibility of storing the digital file containing the Programme in a (permanent or temporary) computer memory), regardless of the technologies and broadcasting standards used (such as ADSL, GPRS, UMTS, etc.) and the features of the conditional access systems used; and on any reception device (TV screen, computer, personal digital assistant, mobile phone and/or other mobile receiver, etc.), for viewing within the ‘family circle’ and/or collectively (including online sharing, classroom projection, etc.).

Temporary Download”: technology that allows Users to transfer a Programme from the Website, upon their individual request and at a time of their choosing, for the purpose of storing it on a storage device for viewing/consulting the Programme for a period of:

- 30 (thirty) days from the date and time of the start of the first viewing, for an unlimited number of viewings of the Programmes on the Website. Under no circumstances may the User permanently download the Programme(s).

 

ARTICLE 1: ACKNOWLEDGEMENT AND ACCEPTANCE OF THE TOU

The User must declare that they have read and accepted these TOU in full when creating their account.

By creating an account, the User unreservedly accepts these TOU.

 

ARTICLE 2: TERMS AND CONDITIONS FOR ACCESSING AND REGISTERING ON THE WEBSITE

2.1. Equipment/Territories

The Website can be accessed 24/7 directly via the following URL: educ.ARTE.tv or www.educarte.fr

To access the Website, you must have:

for Streaming: a computer with an internet connection such as a PC (Windows 10 or later) or Macintosh (OS 10.13 or later) or Linux (any system supporting the AppImage format, for example Ubuntu, Debian, openSUSE, RHEL, CentOS, Fedora, etc.), and/or a Smartphone (iPhone, Android) and/or a digital tablet (iPad, Android).

for Temporary Download: a computer with an internet connection such as a PC (Windows 10 or later) or Macintosh (OS 10.13 or later) or Linux (any system supporting the AppImage format, e.g. Ubuntu, Debian, openSUSE, RHEL, CentOS, Fedora, etc.). Temporary Downloads are also available for Smartphones (iPhone, Android) and digital tablets (iPad, Android) via apps available in the App Store or Google Play.

The Website is accessible in the following territories: France, Monaco, Andorra, DROM-COM, and Germany, Luxembourg, Austria, Switzerland, Lebanon, Canada, Morocco, Italy, Spain as well as in French and/or German educational institutions abroad that have subscribed to the Website with ARTE ÉDUCATION.

In accordance with our browser compatibility model for desktop computers, Chrome browsers that are at least 12 versions old will not receive the updated CDM. The Chrome M121 browser is scheduled for release at the end of January 2024. This means that Chrome 108 (and earlier versions) will not receive CDM updates.
In addition, the Chrome browser is not compatible with versions of Mac OS X prior to version 10.15. This also applies to the Widevine browser CDM.

2.2. Terms and Conditions of Access

ARTE ÉDUCATION grants the User a free, non-exclusive right of access for individual viewing or within the strict framework of the family circle or for collective viewing within the framework of a classroom. This right of access allows the User to consult the Website and the Programmes within the framework of and in compliance with these TOU.

This right of access is granted for the duration of the Subscription agreed by the User’s Institution.

2.3. Terms and Conditions of Registration

Use of the Website is subject to Users creating an account under the following terms and conditions:

The User undertakes to complete the registration form correctly, and in particular to provide up-to-date and complete information.

2.3.1. SSO (Single Sign On) System

Single Sign On (SSO) or single authentication system allows the User to log in to the Website by registering on the website or ENT (Digital Workspace) of the Institution. SSO thus allows Users to be uniquely identified on both the Institution’s website or ENT and the ‘EDUC’ARTE’ Website. When the User registers via the SSO system (as specified below), some of their personal data is collected in accordance with Article 5 “PERSONAL DATA AND COOKIES” of these TOU.

2.3.2 Teacher User Registration:

If the Institution does not have SSO (Single Sign On) interfacing:

In order to access the Website, the Teacher User must click on the “TEACHER – REGISTER” tab on the Website’s homepage and create a teacher account (hereinafter referred to as the “Teacher Account”).

When registering, the Teacher User must first enter the teacher registration code which will have been provided to him/her by his/her School or sent to him/her by email, at the request of his/her School. He/she must then fill in the form reserved for this purpose and provide the following information:

surname and first name,
username,
e-mail address,
password,
subject(s) taught,
area(s) of interest(s)

          Teacher Users may change their information at any time by accessing the “MY PROFILE” section of the Website.

          If the Teacher User forgets or loses their password, they may create a new one via the “FORGOT PASSWORD” section.

          Teacher Users are solely responsible for the use of their teacher account. They are therefore solely responsible for any use made of their password by themselves or by any third party.

          If the Teacher User becomes aware of any fraudulent use of their password, they undertake to immediately inform ARTE ÉDUCATION of the unauthorised use of their account via the “CONTACT US” section.

If the Institution has SSO (Single Sign On) interfacing:

When logging in to the Website for the first time from their Institution’s website, Teacher Users must complete the registration form and provide the following information:

surname and first name (if not provided by the SSO)
e-mail address (optional),
subject(s) taught
area(s) of interest(s)

          Teacher Users may change their information at any time by accessing the “MY PROFILE” section of the Website.

          Teacher Users are solely responsible for the use of their teacher account. They are therefore solely responsible for any use made of their password by themselves or by any third party.

          If the Teacher User becomes aware of any fraudulent use of their password, they undertake to immediately inform ARTE ÉDUCATION of the unauthorised use of their account via the “CONTACT US” section.

2.3.3. Student User Registration:

If the Institution does not have SSO (Single Sign On) interfacing:

In order to access the Website, Student Users must click on the “STUDENT – REGISTER” tab on the Website’s homepage and create a student account (hereinafter referred to as the “Student Account”).

When registering, Student Users must first enter the student registration code provided to them by their teacher, then complete the registration form and provide the following information:

surname and first name,
username,
password,

Student Users may change their password at any time by accessing the “MON PROFILE” (MY PROFILE) section on the Website. If a Student User forgets or loses their password, they can create a new one via the “FORGOT PASSWORD” section using the reset code provided by their teacher.

As stated in the preamble to these TOU, parents (or legal guardians) are responsible for any use made of the student’s account. They are therefore solely responsible for any use made of the password by the student or any third party.

If the Student User or their parents (or legal guardians) become aware that the Student’s password has been used fraudulently, they undertake to inform ARTE ÉDUCATION immediately of the unauthorised use of their account via the “CONTACT US” section.

 

If the Institution has SSO (Single Sign On) interfacing:

When logging in to the Website for the first time from their Institution’s website, Student Users must complete the registration form and provide the following information:

surname and first name (if not provided by the SSO). 

As stated in the preamble to these TOU, parents (or legal guardians) are responsible for any use made of the student’s account. They are therefore solely responsible for any use made of the password by the student or any third party.

If the Student User or their parents (or legal guardians) become aware that the Student’s password has been used fraudulently, they undertake to inform ARTE ÉDUCATION immediately of the unauthorised use of their account via the “CONTACT US” section.

 

2.4.  Educ’ARTE Newsletter (for teachers only):

When registering on the Educ’ARTE Website, Teacher Users will have the option of subscribing to the Educ’ARTE website newsletter by ticking the appropriate box. This newsletter informs Teacher Users of new Programmes available on the Website.

Each Teacher User may unsubscribe from the newsletter at any time by unchecking the corresponding box in the “MY ACCOUNT” section of the Educ’ARTE website.

 

ARTICLE 3: USE OF THE WEBSITE AND ITS FEATURES, VIDEO PLAYER AND INTELLECTUAL PROPERTY

3.1. Website and Programmes

The Website, all its elements and the Programmes are protected by intellectual property rights, in particular by copyright and trademark law.

The right of access to the Website granted to the User (Article 2.2 hereof) does not include any authorisation to reproduce or represent all or part of the Website and the Programmes. Consequently, without ARTE ÉDUCATION’s prior written authorisation, any reproduction or representation of all or part of the Website and/or the Programmes, other than the exceptions provided for by the Intellectual Property Code, shall constitute an act of infringement and may be subject to legal action before the competent courts.

The User therefore agrees, under penalty of civil and/or criminal sanctions, not to represent or cause to be represented, reproduce or cause to be reproduced, adapt, modify, transfer, sell, distribute or imitate all or part of the Website or Programmes. Similarly, the use in any manner whatsoever of the logos and/or trademarks appearing on the Website is prohibited without the express consent of ARTE ÉDUCATION. Any unauthorised reproduction or representation is liable to constitute an infringement of intellectual property rights.

The User accepts ARTE ÉDUCATION’s exclusive editorial control over the Website and Programmes. The User expressly acknowledges that ARTE ÉDUCATION may at any time change or delete all or part of the Website and Programmes, without prior notice and at its sole discretion.

 

3.2. Video Player

ARTE ÉDUCATION has developed a video player that allows Users to view the Programmes in the various language versions available on the Website, subject to the provisions of Article 3.3 below.

ARTE ÉDUCATION geolocates access to the Programmes to the territories defined in Article 2.1 of these TOU.  It is expressly prohibited to circumvent, disable or alter the conditions of access.

The Player is protected by copyright as software and must be used as provided by ARTE ÉDUCATION. Any alteration, adaptation, deletion, decompilation or reverse engineering of the Player, its functions or its appearance is expressly forbidden without the prior written authorisation of ARTE ÉDUCATION.

In accordance with the contractual stipulations agreed with the rights holders, normal use of the Player, as authorised by these TOU, allows the User to view the Programmes via Streaming or Temporary Download, subject to the provisions of Article 3.3 below.

Unless otherwise stated, it does not allow the Programmes offered via the Player to be downloaded permanently.

Consequently, any saving, whatever the process or medium used for this purpose, of all or part of the Programmes that does not fall within the scope of a legal exception provided for by the Intellectual Property Code is expressly prohibited without the prior written authorisation of ARTE ÉDUCATION.

Similarly, it is hereby reiterated that editing, making available to the public or communicating to the public any software, application, website, etc. that allows the normal use of the Player to be circumvented, in particular with a view to permanently downloading all or part of the Programmes, is prohibited.

 

3.3. Using the “Share” Function

The “Share” function allows the User to share the Programmes they have selected on the Website with all or part of their class or, for Teacher Users, with all or part of their network.

The “Share” function also allows the User to share (embed) the video player within the digital workspace of the User’s Institution that has subscribed to the Website, it being specified that in this case, only Teachers or Students of the Institution in question will have access to the video player, to the exclusion of any other third party.

 

3.4. Using the “My Network” Function (function reserved for Teachers)

In their profile privacy settings, Teacher Users have the option of appearing in the directory of Teachers registered on the Website and thus building up a network within the Website.

It should be noted that this Teacher directory can only be viewed by Teachers who are duly registered on the Website.

 

3.5. Using the “Create Extract” Function

The “Create Extract” function allows the Teacher User and the Student User to select an extract from one or more Audiovisual Programmes offered on the Website using the selection tool provided on the Website. The Teacher or Student will also be able to add a title to the sequence thus created, add comments, link it to a school subject and/or school level, and add text/images/sound.

The Teacher or Student may then share the sequence only on the Website and/or with their network (as defined in Article 3.4 above) on the Website and/or with their students.


ARTICLE 4: LIABILITY - Guarantees

ARTE ÉDUCATION expressly informs Users and other personnel involved in the Institutions’ educational activities that the topic headings and school level categories on the Website are only intended to help Users select Programmes. Users and other participating staff remain solely responsible for choosing Programmes and, where applicable, for viewing them in advance to ensure that they are suitable for the target students (age, class, etc.).

The Website and the Programmes are provided ‘as is’ and subject to availability. As it is subject to an obligation of means, ARTE ÉDUCATION cannot be held liable for any damage whatsoever resulting from the unavailability of the Website and/or the Programmes.

Furthermore, by using the Website or the Programmes, the User warrants that they have the capabilities, hardware and software necessary for the safe use of the Website and/or the Programmes and, more generally, the Internet.

The User is fully aware of and accepts the nature of the Internet and its use, in particular the limitations related to technical performance, response times and risks related to the security of communications.

Consequently, ARTE ÉDUCATION does not guarantee that the Website, the Programmes, the Player or any other element of the Website will be free of anomalies, errors or bugs, nor that they will function without failure or interruption. In this respect, ARTE ÉDUCATION may freely determine any period of unavailability of the Website, the Player and any other element of the Website, as well as the Programmes, particularly for technical reasons, to improve the services offered or to optimise their use.

Unless otherwise required by public policy, ARTE ÉDUCATION shall not be held liable for any malfunction of the Website, the Programmes, the Internet network or any interruption in service, regardless of the nature or duration thereof.

Similarly, ARTE ÉDUCATION cannot be held liable for any damage resulting from the use of the Website and/or the Programmes and the Internet network, such as loss of data, computer intrusion, viruses or other unintentional problems, or from a case of force majeure as defined by the case law of the French Court of Cassation.

In general, ARTE ÉDUCATION cannot be held liable for any damage (including direct, personal and certain damage) suffered by the User and/or by third parties and for which it has been proven that ARTE ÉDUCATION’s actions are not the cause of such damage.

Consequently, and in view of ARTE ÉDUCATION’s obligations of means, ARTE ÉDUCATION shall not be liable for any compensation for intangible or material damage, nor for any compensation for damage suffered by third parties, whatever the nature thereof, where it has been proven that ARTE ÉDUCATION’s actions did not cause such damage.

Similarly, ARTE France Développement shall not be liable for connection costs or, in general, any communication costs incurred through accessing and using the Websites and Programmes.

ARTE ÉDUCATION accepts no liability for any malfunctions or unavailability of the Website, regardless of the cause, including:

loss of specific data;

consequences resulting from viruses;

force majeure as defined by case law of the Court of Cassation.

The User and/or the Institutions undertake to indemnify and hold ARTE ÉDUCATION harmless against any damages, claims, complaints, costs and necessary expenses (including reasonable legal fees) arising from a breach by the User and/or the Institutions of these Terms of Use that has caused direct or indirect damage to a third party and/or infringes the intellectual property rights of a beneficial owner.

 

ARTICLE 5: PROTECTION OF PERSONAL DATA

When using the Website, the personal data of Teacher Users and Student Users is processed by ARTE ÉDUCATION in its capacity as Data Controller, under the conditions detailed below.

5.1. Information regarding Teacher User or Student User registration

The following information is collected from Teacher Users when registering on the Website:

This information is processed as personal data for the purposes of providing access to and ensuring the proper functioning of the Website for Users from the Institutions and for tracking Website content consumption.

ARTE ÉDUCATION and ARTE ÉDUCATION’s service providers in charge of hosting the Website are the recipients of the data.

The information is kept only for as long as is strictly necessary for processing, i.e. for the time required to manage the commercial relationship with the affiliated Institution.

In accordance with Act No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, as amended, and Regulation (EU) 2016/679 on the protection of personal data, Users have the following rights over the data specified in Article 5.1: the right of access, the right to rectification, the right to object, the right to erasure (right to be forgotten), the right to define guidelines applicable after death, and the right to restrict processing.

5.2 Information regarding the Educ’ARTE Newsletter, reserved for Teacher Users

The following information is collected when Teacher Users consent to receive the Educ’ARTE Newsletter by ticking the corresponding box:

This personal data is processed for the purpose of informing teachers about new content published on the Website. It is collected based on the Teacher’s consent, which may be withdrawn at any time. The information is kept for the period strictly necessary for processing, i.e. for 3 (three) years from the last contact made by the Teacher.

ARTE ÉDUCATION and ARTE ÉDUCATION’s service providers in charge of e-mailing and hosting are the recipients of the data.

In accordance with Act No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, as amended, and Regulation (EU) 2016/679 on the protection of personal data, Teacher Users have the following rights over the data specified in Article 5.2: the right of access, the right to rectification, the right to object, the right to erasure (right to be forgotten), the right to define guidelines applicable after death, the right to restrict processing, and the right to data portability.

5.3 Exercising your Rights

To exercise their rights, Users may send an e-mail to: PROTECTION-DONNEES-EDUCARTE@artefrance.fr or a letter by post to ARTE France – Data Protection Officer (DPO) – 8 rue Marceau 92185 Issy Les Moulineaux cedex 9, France.

In accordance with current legislation, Users must send their signed request, along with a copy of their ID and the address where the reply should be sent. ARTE ÉDUCATION has 1 (one) month from receipt of the request to respond.

Users have the right to lodge a complaint with the French Data Protection Authority (CNIL).

5.4 Data Security

Data will be hosted by ARTE ÉDUCATION or any third party it chooses for the sole purpose of fulfilling its obligations, on secure servers to ensure that Users’ personal data is protected against loss, fraudulent alteration or unauthorised access by third parties.

 

ARTICLE 6: USE OF COOKIES

According to the CNIL, cookies are “information stored on a user’s hard drive by the server of the website they are visiting”. These cookies, or non-executable text files, are deposited by ARTE ÉDUCATION.

ARTE ÉDUCATION only places cookies on your device that are necessary for the Website to function. These cookies do not require your consent and cannot be disabled as they are essential to the functioning of the Educ’ARTE Website.

ARTE ÉDUCATION does not place any other cookies.

ARTICLE 8: Applicable Law - Disputes

These TOU are governed by French law. Any disagreement or dispute that cannot be settled amicably will be submitted exclusively to the competent French courts.
